The Karnataka High Court Monday denied any interim order against the implementation of the amended new tariff order (NTO 3.0) by the Telecom Regulatory Authority of India (TRAI).
The court was hearing the petition filed by local cable operators (LCOs) challenging the hike in MRPs of pay television channels to Rs 19.
The court stated that the imposition of Rs 19 per channel in a bouquet was as per the Supreme Court’s ruling, which allowed the central government to make changes to the cable operators’ tariff.
Karnataka HC said that since the challenge is to the amendment regulations for imposition of tariff of Rs 19 per channel in a bouquet of channels, which is upshot of the judgment of the apex court, there can be no interim order that can be granted at this juncture.
The objections to the petition are imperative, to be filed by the Union of India and the TRAI. Therefore, the action impugned shall be subject to the result of the writ petition, the court said.
Meanwhile, the Kerala High Court has postponed the hearing in the case filed by the All India Digital Cable Federation (AIDCF) against the implementation of the amended new tariff order to February 22.
The court did not pass any interim order. The members of AIDCF barring Siti Cable were waiting for Wednesday’s court order before they take any decision on complying with the provisions of NTO 3.0.
