In lieu of Tata-owned Trent approaching the judiciary against the alleged usage of the company’s trademark and intellectual property rights by zudiofranchise.net and others, the Bombay High Court has granted interim protection to the company against the infringement of its trademark.
Earlier on, when the company had approached the court against defendants defrauding consumers and falsely representing themselves as the company’s employees by squatting the Zudio domain name and mark, Justice RI Chagla looking at the urgency in the matter had passed the order on November 2 without hearing any of the defendants. The same was deemed effective till December 18.
But later on when Trent informed that the directions had not been complied with, the order was extended first until today and then further to the next date of listing.
Tata-owned trent also claimed that zudiofranchise.net and others had also used the company’s artwork for the services when they submitted the documents in the Court, prusing which Justice Chagla was convinced that the plaintiff made for a strong prima facie case for granting an ex-parte ad-interim relief.
The order, as given by him, read, “From the documents filed, I am convinced that the Plaintiff’s trade mark/artistic work of Zudio is distinctive and has garnered enormous goodwill and reputation.”
In addition to this, Bombay HC also directed the domain registrar Tucows Domain to file a disclosure affidavit containing details of the persons and entities who registered the domain name which allegedly infringed the Zudio mark, suspend the domain name and bring down the website till the suit was finally decided.
