Chief Justice of India (CJI) DY Chandrachud Monday said that the matter between Culver Max Entertainment (formerly Sony Pictures Networks India) and Videocon D2H will be taken up in the next two weeks.
The CJI said that the matter will be taken in the next two weeks on a Friday and added, “We want to consider this a little carefully.”
Senior Advocate Abhishek Manu Singhvi, appearing for the petitioner, said that Sony had provided a package worth Rs 521 crore to the respondents (DTC operators).
“In that, I throw in Sony Pal. I don't increase the price from 521 crores,” said Singhvi.
“Now, Videocon D2H is asking to deduct the price proportional to Sony Pal because the channel is given for free to Prasar Bharti. First is the issue of him treating himself as same as Prasar Bharti,” he argued.
The CJI suggested examining of the agreement and Memorandum of Understanding (MoU) to shed light on the matter.
Senior Advocate Maninder Singh appearing for respondents said that the principle of a level playing field should apply to everyone.
Singh emphasised that even Prasar Bhartiis a licensee under Section 4 of the Telegraph Act.
The CJI then said that the matter will be posted on a Friday after two weeks as the apex court wants to consider this case a little carefully.
