In Britannia Cookies Trademark Infringement case, Delhi HC orders Parle Products to modify two ads

The Delhi High Court has ordered Parle Products to take down its two ads of Parle 20-20 which were disparaging the products of Britannia, which is the owner of the Good Day Butter Cookies product range.

In a big relief to Britannia, Justice Pratibha M Singh told Parle Products to ensure that the aforementioned ads are modified within two weeks by blurring the images of cookies displayed, which are apparently similar to those sold by Britannia.

The Parle 20-20 ads:

The order also stated that the defendant (Parle Products) should ensure that the “currently used cookie image would be no longer visible in the said advertisements on any online platforms from May 1, 2022, onwards.”

The plaintiff, Britannia, had approached the court alleging that the defendant was trying to promote its product ‘Parle 20-20’ cookies by denigrating, defaming and disparaging the plaintiffs’ range of similar products.

Britannia had further filed an application demanding to include two more ads against which it had the same grievance regarding the packaging of the cookies being used in them.

The Court also said that the defendant would not use cookie image in any form which is “violative of the plaintiff’s registered design”, in future too.
