Ltd, which had approached the Delhi High Court after its DAS MSO provisional registration/permission was revoked by the Ministry of Information and Broadcasting (MIB) for non-submission of DAS related Information, has got relief.

The High Court, in its order passed yesterday, said, “Home Cable shall provide all the DAS related information as asked for to the MIB within 24 hours and directs MIB to take a decision on restoring the DAS MSO registration/permission within three days. The petitioner is further permitted to negotiate and enter into DAS Interconnect Agreements with pay TV broadcasters/channel aggregators.”

Home Cable informed the court that MIB's impugned order dated 28.08.2012 was mala fide and prejudiced against the petitioner. It was further argued that there was no ground available with MIB to take such a punitive action against existing MSOs like the petitioner, which already has the entire Digital Addressable System installed and running in place since 2007 and catering to more than 11,000 digital subscribers since CAS was introduced in South Delhi with a capacity to carry 650 digital TV channels.

Home Cable Network had cited various issues concerning the interest of the consumers at large to the MIB but the ministry had failed to address these issues that will affect millions of cable TV subscribers and will result “in a situation of complete chaos, blackouts, exploitation of consumers and eventually deficiency in the service provided, when DAS will be implemented w.e.f November 1, 2012”.
